(“SeniorCheck”), is governed by these legally binding terms and conditions. It is essential that you thoroughly review the following terms of use (the “Terms of Use” or “Terms”) prior to proceeding. By continuing to use the Services, you signify your acceptance of the Terms and your intention to be legally bound by them. Should you disagree with these Terms, you are advised not to use the Services. If you find any future modifications to these Terms of Use unacceptable, please refrain from using the Services

These Terms of Use constitute a legally binding agreement between you (“you,” “your,” or “yours”) and Senior Check Inc. (“Senior Check”). In these Terms, references to “ourselves,” “us,” “we,” and “our(s)” pertain to SeniorCheck, including its domain CanadianSeniors.com, subsidiaries, assignees, successors, affiliates, agents, and/or brands, as well as our Services, depending on the context. Your engagement with the Services is undertaken at your own risk, and we accept no liability for any outcomes. It is your responsibility to verify that any Agent Services or information provided through the Services align with your specific needs.

Any noncompliance with these Terms of Use may result in SeniorCheck taking actions such as (i) restricting your access to the Services and associated privileges, or (ii) implementing other remedies deemed appropriate by Senior Check or its affiliates, agents, and vendors at their discretion. To avert any violations of these Terms and to enforce available legal remedies, we will undertake any necessary technical, legal, or managerial actions as we see fit, without prior notification to you or any other user. The SeniorCheck Privacy Policy and the SeniorCheck SMS Short Code Terms of Service are incorporated by reference and are essential components of these Terms. If you are a paid Real Estate Agent Professional, referred to as "Agent" your use of the Services will also be subject to the Senior Check Service Professional Terms of Use.

 

1.    DEFINITIONS

"Agent Violations" refers to actions by an agent that involve unethical business practices, which may include, but are not limited to, manipulating promotions, exhibiting harassing or intimidating conduct towards anonymous individuals who post questions, maintaining a RECO - List of Convictions for both individuals and businesses, and providing financial compensation for misleading promotions or false advertising.

“Subscriber/ Subscribing Agent” An Agent refers to an individual who has opted to maintain their REALTOR Agent Profile with SeniorCheck on Canadianseniors.com, as subscribed by either a User or a third party.

An "Agent" refers to a broker or individual REALTOR who is registered with various Ontario Real Estate organizations, including the Ontario Real Estate Association (OREA), the Canadian Real Estate Association (CREA), and the Real Estate Council of Ontario (RECO). This individual is also affiliated with one of the 23 local real estate boards in Regional Ontario, and their information and contact details are made available on the Services.

An "Agent Profile" is a comprehensive compilation of details regarding the subscribing agent, including REALTOR information, contact details, years of experience, SeniorCheck promotions, responses to community inquiries, data files, configurations, images, audio-visual materials, and descriptions that offer in-depth insights about the agent. This information is supplied to SeniorCheck by service providers, users, or third parties.

“Anonymous User” designates any person who has registered to utilize SeniorCheck services to submit real estate inquiries to an Agent affiliated with SeniorCheck on Canadianseniors.com, or to engage with a community of regional Ontario Agents also associated with SeniorCheck on the same platform

A "Vendors" refers to a business that offers goods or services at a discounted rate when acquired throughSeniorCheck domain Canadianseniors.com. Typically, a verified SeniorCheck vendor MUST be recognized as a Reputable Registered Business in Ontario (RRBO) and MUST not have any charges against it listed on the Consumer Beware List, which is accessible through the public record website Ontario.ca.

"Promote" refers to any individual, recognized as an anonymous user, who has valued the service rendered by a specific Agent in the past and is presently engaging with senior check services. Additionally, an individual may promote an Agent for delivering a knowledgeable or beneficial response to a real estate inquiry from an anonymous user submitted on senior check forums

The term "Verified Agent" designates an agent who has obtained three or more Promotes through senior check applicationon canadianseniors.com from distinct anonymous users. Agents achieving this threshold are recognized as trusted professionals, making them suitable contacts for individualsseeking real estate information with a vetted Realtor currently practicing  real estate in regional Ontario.

The term “Services” This platform of Real Estate Question Forms advocates for real estate agents who adhere to high professional standards while safeguarding public interests. We seek to raise awareness by having anonymous inquiries to bolster consumer protection and to create a robust social media platform that enables agents to succeed in their business endeavors while educating the public on real estate matters. Additionally, we will soon expand our focus to include Healthcare and Skilled Trades.

“Service Profiles” Agent registesred profiles on canadianseniors.com are designed to engage with Anonymous Users who are posting real estate inquiries within a community.

“Community” Senior Check Inc assists 207 regional communities in Ontario through its Real Estate Question Form platform.

“Content” Anything posted on canadianseniors.com

“Agent/ Broker Content” Content that is sourced from Agents / Brokers, not affiliated with SeniorCheck or its users, and is provided through the Service Profiles.

“Users/ Anonymous Users” Users are individuals who have signed up to access valuable real estate guidance from a verified agent on canadianseniors.com, and they may or may not fall under the communities of Service Providers or Agents.

 

2. USE OF SERVICES

Account - In order to use senior check, you will need to create a register a user or agent account.

Permission to use the Services - You are authorized to utilize the Services in accordance with the limitations outlined herein. Your use of the Services is at your own risk, which includes the possibility of encountering Content that may be deemed offensive, inaccurate, or objectionable. SeniorCheck is committed to safeguarding the rights of minors and encourages parents, legal guardians, and responsible adults to actively participate in ensuring the safe use of the Internet by minors. By accessing our Services, you affirm that you are at least eighteen (18) years old or older, and if you are under this age, you are doing so under the direct supervision of a parent, legal guardian, or responsible adult.

Compliance - You are solely accountable for any legal infractions that may occur while utilizing our Services. It is imperative that you adhere to all applicable local, provincial, and federal regulations concerning your use of our Services, which includes, but is not limited to, Question Forms and Promoting community agents or brokers. We reserve the right, though not the obligation, to modify or delete any content posted by you or other users on the Services, and we may also monitor and take action regarding any activities, implementing necessary measures to regulate comments and manage user conduct within our Services

Agent / Vendor Accounts - To utilize certain features of the Services, you are required to establish an account and profile, providing specific information about yourself. You are accountable for maintaining the confidentiality of your SeniorCheck account password and for any actions taken under this account. It is your obligation to inform us immediately of any unauthorized access to your account. We retain the right to terminate your account at any time, with or without cause. When creating your SeniorCheck profile, it is essential to provide accurate information to enhance the credibility of your contributions. Impersonation of others is prohibited. If you choose to use a pseudonym, be aware that other users may still identify you if you disclose identifying details in your reviews or use the same account information across different Services. For further details, please refer to our Privacy Policy.

Communications from  SeniorCheck / Canadianseniors.com.  By registering an account, you consent to receive specific communications from the Services related to your account. This includes notifications about the status of both your questionsandor promotions to agents' responses, and confirmation of your account setup. Agents will also be notified upon receiving a question, as well as through promotion emails related to inquiries submitted via SeniorCheck, along with confirmation of their account creation.

Services Access - You acknowledge that our Services may not always function without errors, interruptions, or delays. We reserve the right to update, remove, disable, modify features, or discontinue the Services at our sole discretion, and we do not assure their constant availability, functionality, or accessibility at any specific time. We cannot guarantee that the Services will perform as advertised or yield the expected outcomes. You agree not to distribute or share any content from our Services without our prior written consent, except when utilizing the sharing features provided by our Service. Additionally, you are explicitly prohibited from monetizing our Services without obtaining prior written approval from us. You agree to access content solely through our Services or other means authorized by us.

 

Privacy - You affirm that you have reviewed and understood the provisions of our Privacy Policy. Promote Agent - We enable Users to share their experiences of working with you through the Promote Button. Agents can also request and gather promotions from individual Users. You recognize and accept that SeniorCheck reserves the right, at its sole discretion, to reach out to Users regarding the services you offer to obtain their feedback and ratings, which may be displayed on our Services. Furthermore, you acknowledge that SeniorCheck is not liable for any content posted on our Services.

Agent Profile Ownership - You affirm that you possess all required rights to showcase any logos, real estate office signs, profile pictures, and other content uploaded to canadianseniors.com. Furthermore, you assert that your upload of such content and its use by SeniorCheck, as outlined in this Agreement, will not infringe upon any third party's intellectual property rights. Should there be any limitations or restrictions regarding the use or display of these logos, trademarks, or service marks, it is your obligation to inform us in writing of any such restrictions or limitations. of use.

Our Right- We reserve the right to utilize your Content in various manners, including public display, reformatting, integration into advertisements, distribution, and permitting others to do the same on their respective websites and media platforms. You grant us an irrevocable, royalty-free, perpetual, non-exclusive, worldwide license to use your Content for any purpose, affirming that you possess all necessary rights, licenses, and authorizations to provide such a license. This also extends to users of the Services and any third parties accessing the Services, allowing them to access your Content in relation to their use. Furthermore, you irrevocably waive any claims or assertions of moral rights or attribution against SeniorCheck and its users concerning your Content. The term "use" encompasses actions such as copying, public performance or display, distribution, modification, translation, and the creation of derivative works based on your Content.

Advertising - SeniorCheck reserves the right to publicly display advertisements and additional information alongside or within your Content. You will not receive any compensation for these advertisements. The format, method, and scope of such advertising may change without prior notification. These advertisements may be customized based on the content of the Services and Companies featured, and the nature and extent of our advertising may also change without advance notice.  CANCELLATION - SeniorCheck reserves the right to cancel or suspend any of your privileges associated with the use of the Services, either in full or in part, at its sole discretion and for any reason. This includes, but is not limited to, violations of these Terms of Use, the Consumer Review Guidelines, and the Code of Conduct.

REMOVAL OF YOUR INFORMATION - Upon your request and following a thorough review, we may modify or remove your personal data or other information from our active database. Please note that complete deletion of your personal data from certain secure databases may not be feasible; however, in such instances, we will ensure that the data is rendered permanently inaccessible to third parties. Additionally, you have the option to update the personal information we hold about you by accessing your account settings on the Site.
